Brockhole Lakeshore - Terms and Conditions
By hiring a boat or bike or booking an activity ( Lazer Clay Shooting, Krazy Karts & Archery) with us you agree that the following terms and conditions will apply.
General Conditions
- The person booking and paying for the hire (referred to in these conditions as “you”) will be over the age of 18 years. You will be the designated responsible adult and will take responsibility for yourselves and all of the people in the group.
- You will ensure that all members of your group are aware of these terms and conditions and comply with them.
- Children must be accompanied by an adult at all times.
- You and members of your group will not be under the influence of drugs or alcohol. Anyone who appears to be under the influence of alcohol or drugs will not be allowed to hire a boat or bike, or participate in any activity from us and will not be eligible for a refund.
- Bookings are taken by Brockhole Lakeshore either online or in person at the counter.
- Online customers will be issued with a booking reference which you will need to present to Brockhole Lakeshore staff on the day.
- Should you have accessibility requirements you should ring us on (015394 46601) to discuss those requirements.
- From time to time Brockhole on Windermere or other authorised parties carry out photography and/or video recording in the site, which may feature guests. Entry to the site is deemed acceptance of these Entry Conditions, and you therefore agree that the Lake District National Park Authority or any authorised party may use such images in perpetuity in any promotional, advertising or publicity material in any format whatsoever. You further agree that copyright in these materials rests with Brockhole in Windermere or such authorised party (as the case may be).
Cancellation Policy
We have a 48 hour cancellation policy. If you cancel your booking before a 48 hour notice period of the activity's start date you are entitled to a refund. No refunds will be given if the 48 hour notice period has ended.
If your cancellation falls before a 24 hour notice period of the activities start date your booking can be rearranged but not refunded.
Amendment Policy
Your booking can be rearranged free of charge up until 24 hours before the start date of your bookings. After this time no refunds will be given and bookings can only be rearranged at our discretion.
Late Arrivals
A refund will not be given if a participant or hirer who does not take part in any activity or session due to non-arrival or arriving late.
Adverse Weather
Boat hire, bike hire, and activities are weather-dependent.
No refunds will be given due to rain or bad weather unless we cancel the activities ourselves due to extreme weather such as extreme wind and thunder.
If we determine that the weather conditions on the day are not suitable for the type of hire or activity you have booked we will cancel your booking. If we need to cancel your booking we will attempt to contact all attendees as soon as possible and when appropriately provided that we have the correct contact details.
We will offer you a full refund or with your consent, transfer your booking to another time on the same day or to another date.
Liability
We will not be responsible for any damage or loss or other expense to your personal belongings during your rental period or during your activity. Nor will we be responsible for damage or loss caused by your misuse of the bike or boat or equipment provided to you by your failure to observe instructions from our staff, the Windermere Lake Byelaws, the Highway Code or UK Law or local byelaws as appropriate.
You agree to report any accident, damage, theft or deterioration of equipment of which you become aware as soon as possible.
Water-based activities and cycling can be considered inherently dangerous activities with a risk of personal injury or death. You and members of your group should be aware of and accept these risks, and be responsible for your own actions and involvement. You confirm that you and members of your group are medically fit and able to undertake the activity you have booked. You must ensure that you are wearing suitable clothing for your activity.
We will not be liable for any personal injury or death caused as a result of your undertaking of cycling, boating or activities.
You will return all boats, bikes, helmets and any equipment on an activity to us in the same condition you collected it and at the time agreed at your booking.
A charge will be made for any damaged equipment or its late return.
Boat Hire
You and your passengers will wear a buoyancy aid at all times. You confirm that you are competent to manage the hired boat following instruction. The person in charge of the vessel is aged at least 14 years in the case of non-powered boats and at least 16 years in powered boats.
You must be aged 14 plus to go out on the water on a solo vessel, ie. a single kayak or paddleboard. Double kayaks are available for under 14's if accompanied by an adult.
Please note children under 14 require adult supervision at all times.
You will not exceed the maximum number of passengers stated on the boat. You and your passengers will not leave the main seating area of the boat or swim from the boat.
Previous experience is required to hire a Canadian canoe, you are aware of capsize risks and are able to look after yourself and your passengers.
We do not have a safety boat on permanent patrol and we will only despatch a safety boat if we are made aware of an incident on the water.
You will keep 100m away from the shore at all times – Motor Boats only.
Well-behaved dogs are welcome on our boats and paddle sports providing they are cleaned up after if necessary, not tied to anything in the boat and you are comfortable with them being on board with you.
Bike Hire
You must leave a valid form of identification (ID) with us. ID must be in the form of a credit/debit card or photo ID which can be an in date valid Passport or Driving Licence. ID must be in the same name and address as the person booking and paying for the hire.
The hirer is responsible for the bike and the equipment and will be liable for any loss or damage to the bike or equipment. You are also responsible for the security and condition of the bicycle(s) whilst in your care.
Bikes must not be left unattended at any time unless locked securely. You will ensure that the bike is parked in a manner that is safe for pedestrians and other road users and secure from theft or damage.
You and members of your party will wear helmets at all times and ensure that you are visible to other road users.
If a bike is damaged or stolen whilst left unattended, we reserve the right to charge you £200 for the purchase of the bike.
Archery
All participants must be aged 7 years and over.
Any participants under 16 years old will need to be accompanied by an adult throughout the session.
Times for archery sessions are fixed - you will need to arrive ten minutes before your allocated start time. If one or more members of the group are late it may not be possible to incorporate them into the group after instruction has started.
It is the responsibility of any participant to inform the instructor if they have any illness, disability or injury.
Every effort is made to ensure mechanical reliability. In the unlikely event of breakdown, another time slot may be offered at the instructor’s discretion. In the case of intentional damage to property, Brockhole on Windermere will pursue those responsible for compensation.
Clothing Advice - Archery at Brockhole on Windermere is an outdoor activity so it is the participant's responsibility to ensure adequate clothing is worn. Trainers, walking boots and wellies are ideal. (No open-toed shoes, flip flops or sandals).
A waterproof jacket is advisable if rain is forecast. Flexible clothing should be worn to allow arm movement.
Every effort will be made to provide a bow to clients with the correct bow and draw weight poundage.
Any participants not following safety instructions will be asked to leave by a member of Staff and no refund will be given. Safety will be paramount and all participants must follow instructors’ direction at all times.
No one is to ever point a bow and arrow at anyone in jest. This will result in removal from the range.
Arrows should always be loaded whilst pointing in a safe direction down the range at all times. If the participant has long hair it must be tied back, additionally, large earrings must be removed before participating.
Krazy Karts
All participants must be aged 7 years and over. Adults can take part too.
Krazy Karts have a maximum weight capacity of 100kg.
We also recommend a height of 125-210 cm in order to comfortably reach the pedals.
Please note children under 14 require adult supervision at all times. This can be provided as a spectator close to the track, supervisors do not need to take part unless they wish to do so.
Safety will be paramount and all participants must follow instructors’ direction at all times. Please ask the Instructor for clarification if you are not sure about any of their instructions.
The Karts are pedal-powered with electrical assistance which activates after the Kart is moving.
All participants should be capable of pedaling to move the Kart before the electrical assistance is provided by the motor.
Clothing Advice - Krazy Karts is an outdoor activity so it is the participant's responsibility to ensure adequate clothing is worn. Trainers, walking boots, sturdy shoes and wellies are ideal. (No open-toed shoes, flip flops, high heels or sandals).
Laser Clay Shooting
All participants must be aged 10 years and over.
Children must be accompanied by an adult at all times. Safety will be paramount and all participants must follow instructors’ direction at all times.
Please ask the Instructor for clarification if you are not sure about any of their instructions.
Car Parking
Parking at Brockhole on Windermere is limited and we cannot guarantee a parking space for you in our car park but we try to give priority to those pre-booked onto an activity.
Please allow plenty of time to park elsewhere. We advise arriving up to two hours before your scheduled booking to allow time to find a space onsite or elsewhere, particularly in peak periods (school holidays).
